Whether ‘medical services’ fall under the ambit of Consumer Protection Act, 2019 or not?

In a recent judgement passed by the Kerala High court, wherein the respondent lost her left eyesight due to medical negligence by a group of doctors. The court relied upon the landmark judgement passed by the apex court- Indian Medical Association v. V.P Shantha, wherein it was held that medical services would fall under the ambit of Consumer Protection Act, 2019, unless such services are rendered for free of cost or if there is a contract of personal service.

No, as it is against our Fundamental Right- Right to Privacy mentioned under Article 21 and guaranteed to us by the Indian Constitution. There needs to be a Judicial Warrant for such searches, otherwise it would be an illegal search which is against the Constitution & our Fundamental Rights.

Exception to this- Whether there is a recorded reason for an urgency of police intervention or there is an ongoing investigation against the person.

How to file a cyber complaint online?

1. Visit- National Cyber Crime Reporting Portal.

2. Check whether your complaint falls under- a. Cybercrimes against women/children or b. Other related cybercrimes.

3. Choose a. or b.

4. Fill all the details of the victim- When and where the incident took place, was there any delay, etc. In case you are the complainant, you may file the same on behalf of the victim.

5. You can attach screenshots/photos too as evidence, link of the fake profile, etc.

6. Upload the identity proof of the victim.

7. Cross-check and submit, you’ll receive an acknowledgement no. Via text and email.

8. Soon your cyber complaint will get transferred to your nearest police station.

9. You can easily track the status of your complaint through the portal.

Things to remember:

  1. No one can charge anything over the MRP.
  2. If they do so, kindly ask them to give a bill regarding the same.
  3. If denied, then record the entire situation and file a complaint to the concerned authorities and/or you may file a consumer complaint too.

If you want to file any complaint regarding Black Marketing and Hoarding, then mentioned are the concerned authorities as per the Essential Commodities Act, 1955 and The Prevention of Black Marketing and Maintenance of Supplies of Essential Commodities Act, 1980.
